Each State (in the USA) has its own laws pertaining to ownership of a slot machine. Some states allow private ownership and some do not. Each state may also define the age of the slot machine for it to be considered legal. Each state may also define how the machine can be used.

Differences in rules and laws:

Several states permit machines in licensed casinos or gaming establishments or allow the use of machines up to a maximum number of units in certain types of business locations such as bars or convenience stores. Some states also allow for the private ownership and use of machines for social entertainment within one’s private residence or private member/social club.

On a federal level, there is the Indian Gaming Regulatory Act which explains the rights for federally recognized Native American Indian tribes to operate Class II gaming devices and further explained their rights to operate Class III devices when entering into a compact within the state that the tribe has federally recognized land.

For others (not a Federally Recognized Tribe), the federal government turns to each state to regulate the use of gaming and gaming devices within their own jurisdiction. Some states as earlier mentioned may allow casinos to operate slot machines but may limit the private use. Opposite to this, some states may not allow casinos, but do allow for the private and social use of gaming devices with restrictions.

The federal government has not completely “washed its hands” on regulating gaming devices. There is “The Johnson Act” or correctly known as “The Gambling Devices Act of 1962”, where any business that is involved in gaming either through operations, manufacturing, or transporting (along with other descriptive terms) must register with the department of justice.
